The problem is there is nothing about throwing a person ALREADY boarded the flight with a boarding pass. When you get a boarding pass, you're on the flight, no matter what.
Someone screwed during the check in procedure or when issuing boarding passes and this is completely company's liability and will be sued and charged, unless they settle for about $500k, and I wouldn't go for less.
That probably won't be an issue legally- there's an argument that the flight isn't really boarded until the doors are shut and the plane is taking off. Basically why you can't just run on to a plane with a boarding pass and shout "here", and force a plane to take off.
Plus the pilot can kick anyone off that he wants to really.
The plane itself probably wasn't overbooked particularly- it sort of looks like there was a screw up at the last minute elsewhere in their system. Basically four flightcrew members needed to be somewhere else.
You're basically right though- he can sue, and there will likely be a settlement. United did nothing illegal, but the publicity is terrible.

It's kinda easy to dismiss the racial element as funny or non-existent. I guess the basic version of the argument is whether he would have been treated that way if he was a young white woman?

Removed everyone from the plane...Sent bomb sniffing dogs to make it look good...Hell it would have worked in today's world...Then let only employees back on...To fly anywhere they want for free...Who needs paying passengers anyway... Oh, well ...Maybe next time...Lucky I travel by train...As I used to do when I was little, hopping freight trains from close to my house to Micky D's...I would have no problem being asked to jump off the train...Just tumble and roll...But know matter how you try and land...You always scrap you hands up on the gravel...
