Standards of suspicion are significantly higher for the feds. Also, they won't usually just throw you in jail because you fail to have ID. However, the INS is notorious in violating people's rights as well, even those of citizens.

The issue is not the requirement on non-citizens. The issue is that now citizens are required to carry ID, so they can prove they are citizens.
