OK, you are a 104 lb 4' 9" young girl and the car is hit by a 210 lb 6' man screaming "Unlock that door, damnit." Clear case. Now work back to no sound and you get the same result. The whole case is decided on the reasonable belief of the young girl that she is in threat of imminent harm, not the intent of the man.

Dogs are living creatures, and there should be no difference in killing a human than a dog. killing a dog should be murder. Humans are animals too, and dogs can live, breathe, smell, see, and feel. They shouldn't be allowed to be mis-treated.

I guess it depends on the situation then. I wasn't looking to fight with you about it. I was just surprised that this sort of thing was in a California statute somewhere.

If the dog that was killed was a Greek dog, it would certainly be seen as a benefit to society.

In my opinion - killing a dog is murder. It's murder, just like killing a human or a worm."Murderer" has a lot of negative conotations attached but it really can be a good thing. Remember the guy who nearly took out Hitler with the bonb in the breifcase?

What if the situation is that of a 210 lb 6' man sitting in the car and a 104 lb 4' 9" young girl hitting the car with a baseball bat screaming "I'm gonna wreck this fucking car, damnit!"?

I was once being seriously hassled by a police officer for no good reason. I pointed my finger at him and waggled it, saying something like "why don't you just leave us alone, you arse?". He told me that he could arrest me for assault as I had raised my hand to within striking distance of his face.
Surprisingly, in another occasion when a police officer did the pointy thing in my face, he was unimpressed by my relating the former episode to him and threatening him with a citizen's arrest.
