How terrible is it that Gays cannot marry? Depriving them of their basic rights!

I heard New York might be pursuing some legislation to the above effect. Good on them. I like the current trend.

You're clearly not familiar with New York politics.

David Paterson is so unpopular, it's probably a bad thing for gays that he wants to legalize gay marriage.

no... you're wrong. Whether same sex marriages can occur or not is not a big issue. In fact, it is a states issue, not a federal one. So if you live in Cali, it has already been dealt with there. That is all.

I don't interpret it that way. Your not guaranteed the right to marriage by anyone. States have the authority to grant marriage license as they see fit. Your civil liberties are the rights afforded to you by the Constitution... nothing more.

Umm one of the rights afforded to you by the constitution is a guarantee of equal protection under the law, which includes contract law.

So while states do oversee a lot of contract law, if they ever use those laws in a discriminatory way (for example denying black people the right to buy a house, or... I dunno... denying gay people the right to marry), that's a violation of the equal protection clause, which is federal. In fact this was the basis of Iowa's decision on the matter the other week. It's the same way states have their own obscenity laws, but are still subject to the first amendment, and so forth.
