As long as the character has been announced for Brawl, you can choose them. If two or more people choose the same person, they play a game to see who gets it.

it doesn't have to be a newcomer it just has to be a CONFIRMED character at smashbros.com. For example don't go picking Ice Climbers until/if they are confirmed.
and yeah you can, just at a specific date all the people who are picking the same character can have a risk match and the winner can use that character.
