I just saw on TV...... the guy said, "I was with JonBenet when she died." He admitted his guilt, but, says it was an accident. :roll:

it's tough, i mean i'm all for free speech - i was chatting to a friend the other day and in teh UK we don;t have free speech - i mean you can;t incite racial or religious hatred, i.e. no Klan rallies. I don;t know if that's a good thing, but the media shouldn't be allowed to get away with what they do. They should be accountable for stuff like this.

Yes, but the elements of defamation are:

1. Publication of a false and defamatory statement

Publication simply means telling it to people, whether it be a few or on national TV.

2. Publication was not privileged and was done with fault (malice).

Sop, if it is in a court proceeding or other similar circumstance, it is privileged and no one can get in trouble for that, but aside from that, there has to be MALICE. The speaker has to know that the statement is false and injurious, and make the statement anyway. These people believed the statements about the Ramsey's were true, there is nothing to sue over.

3. Injury occurred.

Well, obviously this is true as it was damaging to them.

And to hold the media accountable for defamation there is almost a higher standard, because of the chilling effect on free speech it would have if a media outlet constantly had to be defending defamation suits.

At first there was widespread panic in this area because there was supposedly a child killer on the loose

so people became less afraid because the parents moved to georgia
and the mother did know before her death that there was a suspect in the case
and there have already been at least 6 multi-million lawsuits against the media, 5 settled out of court and the other one thrown out by the judge
there are rumored to be at least another 6 multi-million lawsuits on the way
the ramsey's were rich to begin with, have you seen their old house? and real estate is not cheap to begin with in and around boulder

the original lawsuits were multi-millions, i don't know what the actual settlement was though

of course when a rich white child gets kidnapped its all over the media, but if it happens to a poor or minority person it gets a five minute blurb on the local news channel

just from the little I've read, I am wondering if it's just a sicko's ploy to get attention (hey that guy belongs HERE!). the freak seemed obsessed with her and avoided questions about what caused JB's death.

Agreed, Wicked. Now that more of the story is coming out, things are seeming weird, and he is starting to seem full of shit. If he is lying, that is so fucking sick.

yeah since the conference in bangkok things don't seem completely right
but we will find out more soon as he is being transported here this weekend
it would be kinda weird to be on a plane with a possible killer
glad i don't fly to/from thailand

I dont know i just dont buy it i really believed it was the mother but of course thats kinda how the media wanted it to look i guess... I mean the guy was a school teacher goodness who is a child abuser these days

Well, if Carr isn't the doer, then we all know why he was in Thailand.

If he did kill Ramsey, then Mr. Ramsey has a golden opportunity to sue all the tabloids for lots o' money. It may not be right, but it is opportunity.

If I'm not mistaken this guy was also facing criminal charges in Thailand.

If that be the case then he may have admitted to killing her, so he could get expedidted back to ther U.S. and not do time in a Thailand prsion, where hell was invented.

Not really. Read my post earlier on the requirements to win the suit. Basically, one would have to prove that the tabloids knew that Patsy Ramsey and John Ramsey were not involved, and maliciously pubilshed that they were anyway.

Yes, those are the legal requirements.

We all know that the law does not apply if you've got a savvy enough lawyer, look at the idiot who won a suit against McDonalds for spilling hot coffee all over herself.
