Well let's see Hollande has 14% approval and is still in office so I'm sure Trump will be just fine with 55% approval.

what are you talking about? Trump has not had anywhere near a 50% approval rating. he dipped to 39% at one point. he is barely cresting 40%.

He fires this chaffe up in the air and the news goes into 24/7 refugee cycle because the political economy of journalism means they have to cover protests first. Meanwhile six different executive orders have been decreed pushing forward pipeline construction.

Meanwhile back on topic. It's fun to see establishment Republicans react to Trump's first few days. A lot of them keep forgetting why THEY SUCK. Why Bush would never do that, they cry. But if it wasn't for the war on terror G.W. Bush would have been the same one term president his daddy was. Trump had been a Democrat to know how to fight like one and Democrats never really faced their own tactics before and can't respond.

If you look at Obama's first few months in Office, he too followed a multi pronged attack with his agenda. There was the bailouts, there was GITMO, and so on. If you responded to one you weren't responding to the others. It was hard to organize a cohesive defense against such a multi pronged attack. Trump is doing the same thing only in a blitz manner; it's the wall, it's the tax cuts, it's abortion, it's the sanctuary cities, it's the visa applications.

And the strange thing is that it is working. Doesn't matter if it is not 100%, because if you block one thing the others will get through.

As someone who supports immigration and would like to see the United States have no quotas and make immigration as easy as possible, I am not in favor of President Trump's executive order. It's also rather hamfisted and it's somewhat concerning, if what I've read is true, that he's putting his chief strategist who has no prior security experience in charge of the NSA and fuck-all else. Putting aside that what he's done is also unconstitutional (he's banning immigrants based on national origin and religion), it's also not right. And finally, the amount of Americans killed by terrorism is miniscule. Those caveats aside...

There are a couple of fascinating charts making their way around the interwebs. The first is a chart showing the amount of Americans killed by terrorism compared to other things (e.g. bee stings) which I've referred to. There is also a chart showing the amount of Americans killed by people originating from the "banned" countries and the Americans killed by people originating from the not "banned" countries. They do a good job of pointing out to the uneducated and "hey, look, it's something that proves our initial reaction to Team Trump" people that they are correct and can shout (or whatever that's called when you do it over the internet) at each other how wrong Team Trump is. I agree that what the administration has done is wrong and unconstitutional.

However, the second chart especially is misleading. For example - it does not include people who are not Americans in the death toll. For example, British and Germans and French killed by terrorists originating from the "banned" countries in England, Germany, and France. It does not include Americans and anyone else killed by people from "banned" countries that we are ostensibly at war with (i.e. how many soldiers have been killed in "banned country X"?). If the ostensible purpose of the executive order is to keep Americans safe, we all need a better argument than the second chart. And I only point this out because I've seen it 100 times in the last three days.

Forty-seven percent (47%) of Likely U.S. Voters think the country is heading in the right direction, according to a new Rasmussen Reports national telephone and online survey for the week ending January 26.

This is the first time it’s been in the 40s since late 2012, but it remains to be seen whether this finding represents a new burst of optimism or is just a one-week statistical hiccup.

How is it unconstitutional?

You don't have a right to visit or enter another country. You have to get permission first, from that country. That's pretty much the standard as it's always been. Every nation has the right to determine who comes into their country. If you wanna go to Estonia on vacation and the Estonian authorities, for whatever reason, say "No, you can't enter the country", there isn't a fucking thing you or the US can do about that. Not one fucking thing, your ass just has to go on home.
The EU is a new exercise but just look at what is happening there. The European countries give up their right to determine who comes into their countries and the next thing you know you get the rise of nationalist parties. There is a connection.
People got conned, the EU was supposed to be an economic union, and then the EU technocrats are telling all the EU nations they have to accept whomever from where ever. This pisses people off who actually care about their country and culture and have legitimate concerns about those things being eroded too fast by too much immigration.
There is no doubt that immigration changes the face of a country, is there not? But that change is not always positive, contrary to what the multiculturalist yells at people to convince them otherwise. Unfetter immigration can destroy an entire nation and her people's culture. By telling people "we don't give a f*ck what you think because you are a <insert label here>" is not "winning the argument".

When people scream "Racists! Xenophobe!" they are not convincing anyone to their pov. Shouting down people who have legitimate concerns about immigration does not actually address those legitimate concerns. (Not saying you are doing that TGD). It simply alienates those who have legitimate concerns and they end up voting and giving power to a populist.

Trump's rise is not due to the right, it's due to the left who have flat out ignored, cajoled, shamed and otherwise yelled down any opposition no matter how legitimate. That doesn't convince people to adopt those views, it does quite the opposite.

The United States has in the past place travel bans from nations. They will do so in the future. All nations engage in this sort of stuff. Trump's ban isn't a muslim ban, it's a national ban. It is well within the rights of a nation to do so. It might not be wise, it might not be warranted, it might not even be moral or ethical, but it's business as usual in regards to the State.
Trumps ban is for 90 days with the purpose of developing better vetting systems of those coming into the US.
Obama issued a six month travel ban on Iraq, no one said a fucking word about that, did they? Obama did it for basically the same reason, because immigration officials didn't have the means to properly vet the incoming immigrants to ensure they weren't up to no good.

Under the US constitution there is absolutely no right for any non US citizen to gain entry into the United States. The President has vast power over immigration through established law. And I mean vast. Absolutely there are valid criticism over Trumps ban, but "unconstitutional" isn't one of them.
Obama had the same power, it's why no one could stop his "Dream Act", because the POTUS has very wide discretion on this issue.
The USCIS is part of the DHS and falls under the auspices of the executive branch. I would love for someone, anyone, to point to the part of the constitution that gives any non US citizen the right to enter the United States. Go ahead, point out the exact article or amendment pertaining to such. Remember, Trump's ban is a ban on nationals from a particular country, not religion. So you can go ahead and forget the "He's banning people based on religion" nonsense because the ban is based on citizenship status, something the United States and virtually every other country has done at one point or another through history.

Why are soldiers being added into the equation? As far as I can tell from a casual Google Syrians have killed one American soldier operating in Syria and a couple of hundred European civilians in European cities, while Iraqis have killed thousands of American soldiers in Iraq and no Europeans in their own cities. If you were to enact a blanket ban on people from one country to try and protect American civilians in America, Syria (hundreds killed) would make more sense than Iraq (thousands killed), because it's Syria that terrorists have been exported to NATO cities from.

So Trump decided to bully Mexico, and at first my reaction was of fear because economic speculation can turn things ugly very rapidly. But then I thought, f*ck it, let's hope our president doesn't bend over, doesn't matter what. Thankfully he didn't, and the sentiment all around the country was the same: bring it on, we don't care but that egomaniac isn't gonna bully us.

Now, if he wanted some way of negotiation to get things his way a bit, he could've gotten it. And he still can of course, we're not going to go into a depression over some bits here and there, given a respectful negotiation. But no, his point was to humiliate the country, to make an example out of his image of Mexico and Mexicans. This is what some people secretly like of him, there's a lot of bottled up anger and it's very easy to point fingers and create symbols to direct their anger. Some simpletons they are. "If we do this and that, we're fixing everything, the past will come back, we'll feel young again, times were much better."

But what makes me sad really, is that I read the articles and news and stuff, the irrational and stupid things this president does, and people come to defend him in the comment sections, with so much hate that it's incredible. To the extent people will go to defend their hatred, they will make irrational arguments over and over, to the point of yelling "I CAN'T HEAR YOU I CAN'T HEAR YOU. The polarization is amazing. It's as if one half of people can't believe it, and the other part is enjoying and mocking and doesn't care what happens as long as the evening news work as an outlet of their anger.

Say somehow 4 or 8 years happen and miraculously nothing extreme happens, no wars, not economic turmoil. This president has already done a great harm to the people of the US by polarizing it. The wound will not heal easily.



Saddest of it all is that I go to GC and see some comments that really hurt me because I can't believe persons I liked to interact with have such anger and such want for blood letting. Saddest of it all is that my image of some people I used to enjoy talking to has completely changed. Saddest of it all is the anger this comment will generate on some posters.

There is no polarization here, at least in regards to this particular executive order, niet.

I assume that people understand and accept the rule of law, yes? It doesn't matter if you hate Trump, love Trump or don't care either way. It doesn't matter if you are hard right, hard left, libtard or conservaturd. Let's base our opinions on at least some semblance of fact.

In the matter of the legality of this, in the US the Supreme Court has the final say one way or the other. Here is what the Supreme Court has said on the matter of aliens petitioning to enter the United States-

"At the outset we wish to point out that an alien who seeks admission to this country may not do so under any claim of right. Admission of aliens to the United States is a privilege granted by the sovereign United States Government. Such privilege is granted to an alien only upon such terms as the United States shall prescribe. It must be exercised in accordance with the procedure which the United States provides. "

This is from KNAUFF v. SHAUGHNESSY. The court states clearly that anyone who wants to come into the US cannot do so under any claim of right. None, zero, nada. Entry into the United States is a privilege, not a right, for the non US citizen. The privilege is granted under such terms and conditions as the United States so provides.

Pretty simple, right?

Ok, what does the court say about who decides the rules and procedures? Some might wanna say it's Congress. Others might say it's from the Executive Branch. Here is what the court said about that-

"Petitioner contends that the 1941 Act and the regulations thereunder are void to the extent that they contain unconstitutional delegations of legislative power. But there is no question of inappropriate delegation of legislative power involved here. The exclusion of aliens is a fundamental act of sovereignty. The right to do so stems not alone from legislative power but is inherent in the executive power to control the foreign affairs of the nation. United States v. Curtiss-Wright Export Corp., 299 U.S. 304, 57 S.Ct. 216, 81 L.Ed. 255; Fong Yue Ting v. United States, 149 U.S. 698, 713, 13 S.Ct. 1016, 1022, 37 L.Ed. 905. When Congress prescribes a procedure concerning the admissibility of aliens, it is not dealing alone with a legislative power. It is implementing an inherent executive power.

Thus the decision to admit or to exclude an alien may be lawfully placed with the President, who may in turn delegate the carrying out of this function to a responsible executive officer of the sovereign, such as the Attorney General. The action of the executive officer under such authority is final and conclusive. Whatever the rule may be concerning deportation of persons who have gained entry into the United States, it is not within the province of any court, unless expressly authorized by law, to review the determination of the political branch of the Government to exclude a given alien."


The court says what I said, the exclusion of aliens is a fundamental act of sovereignty. It's fucking legal, because any nation can decide who can and cannot come into their country, period.
Is there any disagreement on this point from anyone? If so, you are shit out of luck because the Supreme Court has already weighed in on this.

So, the court says Congress legislating procedures is usurping executive control and that the legal authority lay with the executive who can then delegate that authority and that actions thus are final and conclusive. So if, as I said, you go to the US and the US, for whatever reason says you can't come in, you can't fucking come in. Period. It's not hard to understand, there shouldn't be any outrage at least to the point of "fascist! Racist!, xeonphobe!" or any other such nonsense. It's fucking law.

This is further reinforced in 1990 ruling which again states-
"The Bill of Rights is a futile authority for the alien seeking admission for the first time to these shores. But once an alien lawfully enters and resides in this country he becomes invested with the rights guaranteed by the Constitution to all people within our borders"
The Bill of Rights is a "futile authority" for an alien seeking admission to the US. You can't cry "But my 5th amendment rights!" don't fucking apply because you are not an American citizen and who comes into and out of the country is a fundamental sovereign right. The US, more specifically, the fucking President, has broad power to say who the f*ck comes into or leaves the country.

Anyway, the 1990 case United States v. Verdugo-Urquidez was a drug lord from Mexico that was arrested, brought back to the US for trial. The DEA, with the Mexican government's permission, searched the defendants property and found some damning evidence. The defendant attempted to claim that his 4th amendment rights were violated so as to exclude the evidence. The court found against the
Verdugo-Urquidez and said in the majority opinion that the 4th amendment rights referring to "the people" was to protect the people of the United States, not fucking Mexican people, or Iranian or whomever.
In addition, Verdugo-Urquidez was in the US legally but involuntarily (in handcuffs, Har!) and thus this did not constitute a sufficient relationship. A legal alien who comes to the US, legally, resides here, works here, has family here, or many other combinations that show a relationship with the US are protected by the Bill of Rights.

The TLDR version- The Supreme Court has already ruled that the Executive Branch can set rules and procedures for immigration, entry into and out of the United States and that this power is broad, legal and a sovereign right of the United States.

Case fucking closed. Absolutely, one can argue that what Trump is doing is wrong, there are arguments there for that. But, any intellectually honest argument will not include anything about the Bill of Rights, racism, xenophobia or the Constitutionality of it. Those arguments fall completely flat from established law, US law at least, and last I checked the US is still a sovereign nation.

One can argue about the fairness of it, but rarely does the State act fairly and the argument against this action turns to an anecdotal one. One can argue the wisdom of it, which is probably the strongest argument against Trump's move, but then one will have to also acknowledge and explain how Obama's banning of visas for Iraqis for six months is any less wise than Trump's move. IMO it was probably a good idea for Obama to do it at the time because national security concerns. Trump has those same concerns, and I'm not one who much likes the "national security" label put on things. But Obama did it, now Trump is doing is. Cry a fucking river hypocrites who said not a fucking word when "their guy" did it but now it's some sort of evil twisted plot now that "the other guy" is doing it.

The argument I'd make, because despite my sometime callous nature, I do truly want to see people helped who need it. People fleeing the hell holes that are Syria, Libya, Somalia and the such, I can empathize and completely understand. I just don't know if the best thing is to just let everyone in to this country because it doesn't address the actual cause. It's like treating cancer with pain killers, you are still fucking dying you just aren't in as much pain. These people fleeing from their chaotic nations, look to the like of Hillary fucking Clinton, miss "we came, we saw, he died, har har har" herself who owns the debacle that is Libya. She owns the debacle that is Syria. The past two administrations also own the chaos of this immigration problem. They played the role to create the circumstances that forced all these people to have to flee.

All this forces people to have the distasteful obligation to defend Trump. Trump didn't create this fucking mess you fucking morons and it is a fucking mess. Trump is now trying to fix it, I don't know if he can. I don't know if what he's doing will even help, but by God he did not fucking cause this fucking mess.
