Excessive Force?

all i have seen is the Youtube video but he shouldn't have started throwing things and brandishing a "weapon" or whatever it was...

...and the police should have been informed before going there on what was going on...

I voted undecided, because the man was clearly avoiding the police officers instructions. When he gets out of the car, the driver steps forward in the direction of the officer with his finger pointing and his other hand looks like the driver is trying to hide it from sight of the officer (I mean, I know that if I am a cop, I am going to be thinking weapons or drugs).

The officer tells the driver to turn around and put his hands behind his back and the driver clearly does not comply and it looks like the driver is going to flee. Granted, the officer does not tell the driver he is under arrest and never reads him his rights.

The officer also clearly lies on the videotape by saying he warned the driver to comply or he was going to taser him. The officer did not do this.

This case could go either way and before you start getting into an arguement with police, you should keep in mind that cops are always paranoid...so, this driver really needed to just comply and fight this in court.

I don't know what the laws are concerning not signing tickets...it sounds like the driver wanted the cop to show him evidence of the speed limit postings, I guess.

So, I also feel the cop could have done something else other than tasering.

This is a hard one.

In the good 'ol days, the cop would've just shot him!

But I agree that as a citizen, he should have just complied...but I don't know what the laws are governing tasers and unsigned speeding tickets. I mean, the driver was trying to get the officer to provide the essential evidence for the case, but the officer was having nothing to do with being told what to do.

I say let the courts decide this one, I am, however, agreeing partially with soundout on this one.

But the cop did lie... :wink:

You have to put yourself in the officer's paranoid shoes. How would you react? The call is tough...it could go either way in this case. Whether you agree with cops or not...they have a job to do, and the best thing to do in such everyday nominal cases like this, is to just comply.

This driver just made a big headache for everyone involved: the cop, himself, his wife, etc...in this particular case, compliance would have been the best solution. Then all the driver had to do is take it to court, he probably would have either won the case or had the penalties reduced.

I always take my tickets to court, and either they get dismissed or I get my fine or penalties lessened under court descretions.

Tasering sucks, but like I said...in the good ol' days it might have been a bullet!

you have to realise that the police are often dealing with crazies who are as likely as not to be armed - tough to always be Mr Nice Guy in these scenarios.

You grow up your entire life being told violence is wrong. You start a fight at school, you get detention. You have a fight with your brother at home, mum sends us to our rooms. But then you have cops who are given authority to be violent? And everyone fucking goes along with it because your dumb enough to believe they are there to help you. HA! -

Police are part of our society, we should respect that. And if a cop tells me to turn around and put my hands behind my back, I am going to do it. This driver should have never walked towards the officer in a total belligerent manner, plus the driver totally had his arm in his pocket as if he was trying to provoke the whole incident. I mean, the driver should have kept both his hands out in plain sight for the officer, the police man only reacted according to his observations.

And why do you have to use vulgar language? That in itself signifies some form of violent thought, in my opinion. So you are not without sin, as well.

Provoking the police is never a good idea or strategy. Our good freind Jesus went out of his way to befriend the authorities at the time, and probably is what kept him from being killed during his ministry until he was finally betrayed by an infiltrating force.

The best thing for that driver to have done, was just listen to what the cop had to say, state to the officer that you will see him in court over the infraction, sign the ticket, and keep going on your vacation with your little wife...nope, not this guy. He decides to just disregard the police officer by first not signing the ticket, and then not complying to orders.

If you can not see the billigerence in this driver's attitude, you are quite blind and a bit off to the side of the criminal, I am afraid.

As I said, this call is tough...but the more I keep talking about it, I am leaning in favor of the police officer on this one.

As long as you don't specifically say, "Don't tase me, bro!" it's easy to give the cop the benefit of the doubt. Maybe you want electricity in you, how's the cop supposed to know? Split-second decisions and all that.
