so..now new charges by the state..and on top of it, just got nailed testing positive for weed...

i say hes goin for about 2

The sentence will either be One Year plus one day (under federal law, an inmate can generate "good time" only if sentenced to a term in excess of one year, hence the xtra day) (which means that he would serve around 10 months of actual incarceration), or because he can't pass a drug test during the time period between plea and sentencing, the judge may not abide by the purported plea bargain and slam him in the 3 year range.

U.S. federal criminal sentencing is based upon a number generated by the nature of the crime, mitigating circumstances and extenuating circumstances etc. Once you get that number, you look in an established grid to get the sentence.
