Botanically, it's a fruit. It has thick skin covering seed-containing flesh.

However, in the 19th century the Supreme Court ruled that tomatoes are vegetables and are thus subject to vegetable trade tariffs (there were no tariffs for fruit imports back then).

So, in the end, it's still a fruit.

To that, I might add that a true fruit must be composed at least partly of ripened plant ovary tissue.

Taste, edibility, culinary usage or sugar content is irrelevant to to whether a plant organ is a fruit or not.

Also note, the original poster misspelled both tomato and vegetable.
