I might be wrong but I believe I saw a free player the other day with 4 active games and one or two waiting for players. Number one: is that possible? Number two: what if they start while still having 4 active?

He may have recently lost his premium so that he had all those games, and then lost premium but he was still in all those games.

He could have been eliminated. Eliminated games count toward your active games when you do a game finder search, but not toward the freemium 4 game limit.
