To build on Mr Changsha's point, we are missing something fundamental with the OP, and that is consent and mutually beneficial exchange.
With any exchange, there must be some clarification of consent before an exchange can occur. Furthermore, if one person is willing to supply a rousing spectacle in public and if the others have the demand, i.e. agree to this performance ex-ante, then there cannot be a problem with waving one's penis in public. This would be a mutually beneficial exchange.
Of course, the gray area of implied consent can be troublesome, and the exchange ex-post may reveal that the expected profits have failed to offset the opportunity costs for each interested party. Other problems are one of definition. "RE: shoving down throats, how deep will it be? What is the girth? When did you last bathe?"
These considerations should not be overlooked.
